Modern technological advancements are rapid and complex, and the ways they are implemented are also changing in various ways. In such an environment, broadly protecting the core idea of an invention can have limitations with traditional structural claims. Accordingly, domestic and international patent laws are gradually developing toward broadly recognizing "functional claims" that encompass the 'function' of an invention itself. In the Korean Patent Act as well, the 2007 amendment (Article 42, Paragraph 6 of the Patent Act) explicitly allowed functional claims, and their usage has steadily increased. However, functional claims offer a broad scope of protection while being difficult to meet the clarity requirement (Article 42, Paragraph 4, Subparagraph 2 of the Patent Act) and the specification support requirement (Article 42, Paragraph 4, Subparagraph 1). Therefore, it is essential to carefully understand and appropriately utilize these systems and requirements. In this column, we will comprehensively examine the definition and significance of functional claims, the basis and major case law under Korean patent law, comparisons with overseas systems, and strategies for drafting and utilizing them.

Definition and Significance of the Functional Claim

1) Concept of Functional Claims
A functional claim refers to a claim that defines the components of the invention with a focus on the "function" or "effect" performed by the component, rather than describing them with specific physical or structural limitations. For example, instead of writing "bolts and nuts that connect A and B," the function itself is billed as "a means of connection for joining A and B."

2) Necessity of Functional Claims

  • Comprehensive implementation methods: As technology advances, there are many examples where the same function is performed but implemented differently. By charging as features, you can effectively cover new technologies or alternative designs that have yet to emerge.
  • A concise expression of complex structural inventions: Functional claims are especially useful in technical fields such as software, medical devices, biotechnology, and chemistry, when it is difficult to specify all structural and material features.

Example of a functional claim

  • Regarding printers,
    • A communication interface unit for receiving print data;
    • An image processing unit that generates a print image based on the received print data; and
    • A printing unit that transfers toner onto paper according to the generated print image;
    • Printers that include the above.
  • Regarding the method of providing information via the server,
    • The step of receiving the request signal from the user terminal; 
    • A step of analyzing user information contained in the request signal; 
    • Based on the analysis results, generating personalized recommendation information for the user; and
    • A step of transmitting the generated recommendation information to the user terminal;
    • How information is provided, including the above.

Legal Basis for Functional Claims under Korean Patent Act

Article 42, Paragraph 6 of the Korean Patent Act clearly states that the patent claims may include "[structure, method, function, substance, or their combination relationships]" in the patent claims. This regulation was established to improve the situation before 2007 when the permitting of functional claims was somewhat ambiguous and to support technological innovation. However, at the same time, Article 42(4)(2) and (4)(1) (specification support requirement) of the Patent Act serve as safeguards to prevent the abuse of functional representation and unjustly expand the scope of rights.

Interpretation of the functional formula claim through major case law

Domestic courts have established the following principles in interpreting functional claims.

  1. The wording of the claim takes precedence: Even for functional claims, the wording of the claim itself is first interpreted as the standard.

  2. References to specifications and drawings: If the claim wording is unclear, the technical meaning is determined by comprehensively considering the descriptions in the specification and drawings.

  3. Abuse prevention: If the functional representation is too broad or ambiguous to determine the scope of the invention, the patent may be invalidated or rejected due to violation of clarity requirements or lack of support.

For example, Supreme Court ruling 2007Hu4977 held that the wording of the claims should take precedence over functional claims, supplementary interpretation of the technical meaning of terms through specifications and drawings, and that unfair expansion or reduction is not permitted. Furthermore, the Supreme Court ruling 2009Hu92 presented the principle that "claims should be reasonably interpreted in light of the specification, and if interpreting the text as is clearly unreasonable, a limited interpretation is permitted."

Advantages and Disadvantages of Using Functional Claims

1) Advantages

  • Wide coverage: Can collectively encompass various variants and alternatives that perform the same function
  • Flexibility in technological advancements: Includes unforeseen implementation methods in a rapidly changing technological environment
  • conciseness: Intuitively presents complex inventions and emphasizes core functions

2) Disadvantages

  • Clarity issues: If the functional representation is overly abstract, the scope of the invention may become opaque
  • Difficulty meeting support requirements: If the specific structure, method, or algorithm supporting the claimed function is not disclosed in the specification, the risk of rejection or invalidation increases.
  • Uncertainty in Rights Interpretation: Likely to lead to complex interpretation disputes in infringement and invalidation lawsuits

Functional Claims and Clarity Requirements

Article 42, Paragraph 4, Subparagraph 2 of the Patent Act requires that claims be described "clearly and concisely." Since functional claims are not inherently structural, clarity must be ensured in the following ways:

  1. Initiation of Specific Examples: Faithfully describe one or more specific implementation plans for performing the functions claimed in the specification so that the skilled technician can recognize the scope of the claims.
  2. Technical Effects and Operating Principles Explained: By clearly explaining the operating principles and effects of the invention, it supplements technical understanding of the functional representation.
  3. Avoid using ambiguous terminology: Extremely abstract expressions like "appropriate means" are highly likely to be rejected, so you should choose clear technical terms commonly used in the field.

Examination Criteria of the Korean Intellectual Property Office (KIPO)

KIPO does not prohibit functional claims themselves, but under Article 42, Paragraph 6 of the Patent Act, it requires that the invention be "clearly specified" by describing structure, method, function, substance, etc. In particular, the following points are carefully reviewed.

  • Specification Support Requirements Met: Whether specific means, materials, algorithms, etc. for performing functions are described
  • Clarity Requirements Met: Whether a regular technician can specifically identify the requested function

In software-related inventions, functional expressions such as "module performing a specific function" or "data processing means" frequently appear, so it is important to sufficiently support the function with algorithm-level explanations or detailed flowcharts to avoid rejection.

Comparison with major overseas countries

1) United States

  • Legal Basis: 35 U.S.C. § 112(f) (formerly § 112(6))
  • Features: If expressions like "means for ~" or "step for ~" are present, they are presumed to be functional claims, and the scope of the claims is limited by the structure (or equivalent) disclosed in the specification.

2) Europe (EPO)

  • Legal Basis: EPC Article 84 (Clarity)
  • Features: While it emphasizes clarity and support requirements and does not prohibit functional features themselves, practical interpretive guidelines have been developed to prevent broad claims for rights.

3) Japan (JPO)

  • Legal Basis: Article 36 of the Japanese Patent Act
  • Features: Similar to Korea, claims are allowed to be expressed by function, nature, or effect, but sufficient examples and specification support are required.

Thus, major developed countries recognize functional claims while applying various interpretive criteria to ensure clarity and feasibility.

Actual Examples and Precautions When Writing

1) Features in real-life cases

  • Software: Expressed as "a module for transmitting data" or "a means to perform a specific function," etc.
  • Medical Devices: "Components that detect biometric signals," "Means for identifying abnormal conditions," etc.
  • Method Invention: "The stage of generating specific data," "The stage of performing calculations using the generated data," etc.

2) Writing Strategy

  1. Accurate Functional Terminology Selection: Adopt commonly used terms in the relevant technical field to ensure the claim wording is not ambiguous.
  2. Detailed examples of implementations are faithfully recorded in the specification: Always include one or more specific examples of what functions can be performed (hardware architecture, software algorithms, etc.).
  3. Multi-layered protection: Under the top-level claims (broad functional claims), specific structural features are gradually limited to subordinate claims to secure a diverse scope.
  4. Prior art search: Functional claims may pose a high risk of conflicts with prior art, so thorough pre-filing research is essential.
  5. Coordination of overseas application strategies: The United States needs to establish different expressions and claims for each country, taking into account the application of § 112(f) and the clarity review in Europe and Japan.

Impact on Disputes and Litigation

Functional claims offer broad protection and can be advantageous in infringement lawsuits, but they are also prone to invalidation judgments.

  • When determining infringement: Even if the defendant's product or method differs from the specific structure disclosed in the specification, performing the same function is likely to be recognized as infringement.
  • In case of invalid judgment: Excessively broad functional representations risk being invalidated on grounds such as negating novelty or inventiveness or insufficient specification support if the gap with prior art is not adequately explained.

As an overseas example, the United States Amgen Inc. v. Sanofi The case was ruled invalid because an invention that broadly claimed the binding properties of antibodies as functional expressions did not sufficiently meet the enablement requirements, which clearly demonstrates how careful the formulation of functional claims must be in the field of biotechnology.

Conclusion and Recommendations

Functional claims have established themselves as a broad way to protect inventive ideas in a rapidly changing technological environment. Korean Patent Law has also developed in a direction that allows this while curbing reckless abuse through clarity and support requirements. Therefore, patent applicants and their representatives who wish to utilize functional claims should be aware of the following:

  1. Ensuring clarity of functional claims: Use specific and clear expressions commonly used in the technical field, but provide sufficient examples of embodiments performing the function to reasonably define the scope of the claims.
  2. Parallel to Structural Claims: By broadly claiming functions as main claims but gradually limiting specific structures or methods through dependent claims, various strategic options can be secured in the event of disputes.
  3. Considering overseas applications: Since examination standards and case law differ in countries such as the United States, Europe, and Japan, it is important to understand the interpretation of functional claims and limiting factors in advance when planning patent strategies for each country.
  4. Expert Advice: Functional claims are extensive but require delicate legal and technical judgment, so it is advisable to prepare and file in cooperation with experienced patent attorneys or lawyers.
  5. Policy Recommendations: If KIPO establishes more detailed guidelines for functional claim examinations by technology field (especially software, bio, and medical fields), the predictability of examination and the stability of applicants will improve.
