Korean Patent Firm Controls for Conflicts, Deadlines and Instructions
Conflict clearance, deadline control, and confirmation of authority are basic requirements in a Korean patent engagement. Each control should be documented at intake and applied throughout the matter.

Conflict clearance
A conflict check requires the applicant or owner, relevant affiliates, known adverse parties, and enough subject-matter information to define the engagement. Contentious matters may also require licensees, counterparties, and related proceedings.
The result should state the scope cleared. Approval for routine prosecution of one portfolio does not resolve conflicts arising from a later opposition, invalidation action, transaction, or enforcement matter.
If an urgent instruction requires a staged check, the firm should identify what has been checked and limit the confidential information received until clearance is complete.
Official events and deadlines
The Korean representative should docket from the official MOIP communication and verify the event, service date, applicable period, and extension rules. A separate client reporting date should allow sufficient time for translation, review, and instruction.
MOIP states that official information for a patent application is sent to the applicant's Korean address or, for an overseas applicant, the Korean address of the representative. The official notice and record therefore remain the primary sources for docketing.
Deadline classification
- A statutory deadline is fixed by law and may be non-extendable or subject only to limited relief.
- A designated deadline is set in an official notice and may be extendable under the applicable rule.
- An internal deadline is an earlier date set for instructions, drafting, or review.
- An expected date is a forecast and is not an official due date.
Each docket entry should identify its category. An internal instruction date should not be reported as the legal deadline, and a forecast should not be recorded as a fixed official event.
Dual docketing and reconciliation
Korean counsel and foreign counsel should maintain independent dockets. Reconciliation should compare the matter number, official event, due date, extension status, and responsible person.
When a portfolio is transferred, counsel should compare the MOIP record, outgoing counsel's docket, incoming counsel's docket, and the client's portfolio list. Any discrepancy should be resolved against the official record.
Authority to instruct
The engagement should identify who may authorize filings, amendments, abandonment, appeals, payments, and ownership changes. Inclusion on an email chain does not establish authority.
Withdrawal, abandonment, cancellation of claims, non-payment, and other acts that may terminate rights require clear confirmation. The file should record the instruction and the person who gave it.
Ambiguous instructions
Counsel should not choose among multiple claim sets or filing versions without instruction. The response to an ambiguous request should identify the available versions, the unresolved issue, and the latest safe time for a decision.
An instruction to extend a deadline should also identify the matter and official event. The acknowledgment should state the resulting due date and any remaining limits on further extension.
Missing instructions
The engagement should specify reminder intervals and escalation contacts. An escalation path commonly includes the handling associate, supervising partner, client docket contact, and emergency contact.
Absent advance authority, local counsel should not assume permission to incur an official fee or file a substantive response. If a protective step is available, counsel should state its cost, legal effect, risk, and last decision time.
Urgent filings
For an urgent filing, counsel should confirm conflict clearance, authority, filing route, verified deadline, applicant identity, minimum filing documents, translation status, fee payment, and outstanding formalities.
The filing advice should distinguish defects that may be cured after filing from omissions that prevent a filing date or impair a priority claim. Urgency does not change the legal consequence of a missing document.
Information security
Conflict data, unpublished inventions, and client instructions should be exchanged through approved channels. Access should be limited by role and need. Matters involving export-controlled or security-sensitive technology may require additional transfer and access controls.
